ISAI Cybersecurity AI Public Terms of Service
Effective Date: January 2, 2026
These Public Terms of Service ("Terms") constitute
a legally binding agreement between you, the user ("User,"
"you," or "your"), and ISAI Cybersecurity AI
("ISAI," "we," "us," or "our"),
governing your access to and use of ISAI's AI-powered cybersecurity services,
including all associated software, applications, features, and content
(collectively, the "Service").
By accessing or using the Service, you acknowledge that you
have read, understood, and agree to be bound by these Terms. If you do not
agree to these Terms, you are not authorized to use the Service.
1. Acceptance of Terms
1.1. Agreement: Your use of the Service signifies your explicit acceptance of these Terms, our Privacy Policy, and any other policies or guidelines referenced herein. These documents collectively form the entire agreement between you and ISAI.
1.2. Eligibility: You represent and warrant that
you are at least 18 years of age and have the
legal capacity to enter into this agreement. If you are accessing or using the
Service on behalf of an organization, you represent and warrant that you have
the authority to bind that organization to these Terms.
2. Description of Service
2.1. Core Functionality: ISAI provides advanced artificial intelligence-driven cybersecurity solutions designed to detect, analyze, and mitigate cyber threats, identify vulnerabilities, and enhance the overall security posture of your systems and networks. The Service leverages machine learning, natural language processing, and other AI technologies to provide proactive security insights, automated threat responses, and comprehensive security reporting.
2.2. Service Evolution: ISAI reserves the
right to modify, suspend, or discontinue the Service, or any part thereof, with
or without notice, at any time. We shall not be liable to you or any third
party for any such modification, suspension, or discontinuance.
3. User Responsibilities and Obligations
3.1. Lawful Use: You agree to use the Service solely for lawful purposes and in a manner that does not infringe upon the rights of others, restrict, or inhibit anyone else's use and enjoyment of the Service. Prohibited conduct includes, but is not limited to, using the Service for any illegal activity, transmitting harmful code, or engaging in any activity that could damage, disable, overburden, or impair the Service.
3.2. Account Security: You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify ISAI immediately of any unauthorized use of your account or any other breach of security. ISAI cannot and will not be liable for any loss or damage arising from your failure to comply with this obligation.
3.3. Accurate Information: You agree to provide accurate, current, and complete information during the registration process and to update such information to maintain its accuracy.
3.4. Ethical AI Use: You shall not use the Service to generate, disseminate, or promote content that is illegal, harmful, discriminatory, or unethical. This includes, but is not limited to, using the AI for malicious cyber activities, generating misinformation, or infringing upon intellectual property rights.
3.5. Compliance with Policies: You agree to
comply with all applicable laws, regulations, and ISAI's internal policies,
including our Privacy Policy and any Acceptable Use Policy, which are
incorporated by reference into these Terms.
4. Data Usage and Privacy
4.1. Privacy Policy: Your use of the Service is subject to ISAI's Privacy Policy, available at [Insert Link to Privacy Policy]. The Privacy Policy details how ISAI collects, uses, processes, and protects your Personal Information and other data, including specific provisions related to the EU AI Act, CCPA/CPRA (2026 Amendments), and the NIST AI Risk Management Framework.
4.2. Data Processing for Service Delivery: You acknowledge and agree that ISAI will collect and process technical data, including system logs, outbound prompt data, and generated security outputs, as necessary to provide, maintain, and improve the Service, detect and mitigate cybersecurity threats, and enhance the performance of our AI models. This processing is integral to the Service's functionality.
4.3. Sensitive Personal Information (SPI): In accordance with our Privacy Policy and the 2026 CCPA/CPRA amendments, ISAI provides mechanisms for users to limit the use and disclosure of Sensitive Personal Information (SPI) for purposes beyond basic security functionality.
4.4. Neural & Biometric Data: If the
Service incorporates features utilizing behavioral biometrics or neural data,
ISAI will adhere to all applicable state and federal regulations concerning the
collection, processing, and protection of such data, as detailed in our Privacy
Policy.
5. Intellectual Property Rights
5.1. ISAI's Intellectual Property: All intellectual property rights in and to the Service, including but not limited to software, algorithms, AI models, documentation, trademarks, and content (excluding User-generated content), are owned by ISAI or its licensors. You are granted a limited, non-exclusive, non-transferable, revocable license to use the Service solely for its intended purpose, subject to these Terms.
5.2. User Data: You retain all intellectual property rights in the data you provide to the Service ("User Data"). You grant ISAI a worldwide, royalty-free, non-exclusive license to use, reproduce, modify, adapt, publish, and display User Data solely for the purpose of operating, improving, and providing the Service, and for compliance with legal obligations.
5.3. AI-Generated Outputs: Outputs
generated by the Service based on your input (e.g., security reports, threat
assessments) are provided for your internal use. While you may use these
outputs, ISAI retains ownership of the underlying AI models and algorithms. Any
synthetic content generated by ISAI will be explicitly labeled as AI-generated,
in compliance with Article 50 of the EU AI Act.
6. AI-Specific Clauses and Limitations
6.1. Automated Decision-Making Transparency: ISAI employs Automated Decision-Making Technology (ADMT). We commit to providing plain-language notices explaining the logic, purpose, and potential outcomes of ADMT, as detailed in our Privacy Policy. For high-stakes decisions, users have the right to opt out of automated decision-making and to appeal the AI's output to a human reviewer.
6.2. Limitations of AI: * Accuracy and Bias: While ISAI strives for accuracy, AI systems are probabilistic and may produce errors, inaccuracies, or reflect biases present in training data. The Service is not a substitute for professional human judgment. * No Guarantee: ISAI does not guarantee that the Service will be error-free, uninterrupted, or that all security threats will be detected or prevented. The Service is provided "as is" and "as available." * Human Oversight: Users acknowledge that human oversight remains critical, especially for critical security decisions. ISAI explicitly discloses where human-in-the-loop processes are integrated.
6.3. Prohibited AI Use: You shall not use
the Service to: * Develop or train competing AI models. * Reverse engineer,
decompile, or disassemble any part of the Service or its underlying AI models.
* Circumvent any security measures or access controls of the Service. * Generate
or propagate malware, phishing attempts, or other malicious content.
7. Security and Compliance
7.1. Security Measures: ISAI implements and maintains robust technical and organizational security measures designed to protect the confidentiality, integrity, and availability of the Service and your data. These measures align with industry best practices and recognized frameworks such as NIST Cybersecurity Framework (NIST CSF) and ISO 27001. 7.2. Compliance: ISAI operates in strict compliance with applicable data protection and privacy laws, including the General Data Protection Regulation (GDPR), the California Consumer Privacy Act (CCPA) as amended by the California Privacy Rights Act (CPRA) (2026 Amendments), and the EU AI Act. Our AI development and deployment are guided by the NIST AI Risk Management Framework (AI RMF), demonstrating our commitment to "Privacy by Design" and "Security by Design."
7.3. Breach Notification: In the event of a data breach affecting Personal Information, ISAI commits to notifying affected users within 30 days of discovery, in accordance with applicable regulatory standards.
7.4. Audits: ISAI undergoes mandatory
annual cybersecurity audits as required for high-revenue or high-risk
businesses in California, ensuring continuous assessment and improvement of our
security posture.
8. Disclaimers and Limitation of Liability
8.1. Disclaimer of Warranties: THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR COURSE OF PERFORMANCE. ISAI DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, OR THAT DEFECTS WILL BE CORRECTED.
8.2. Limitation of Liability: TO THE
FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL ISAI, ITS
AFFILIATES, DIRECTORS, EMPLOYEES, AGENTS, OR LICENSORS BE LIABLE FOR ANY
INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING
WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE
LOSSES, RESULTING FROM (I) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR
USE THE SERVICE; (II) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SERVICE;
(III) ANY CONTENT OBTAINED FROM THE SERVICE; AND (IV) UNAUTHORIZED ACCESS, USE,
OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT, WHETHER BASED ON WARRANTY,
CONTRACT, TORT (INCLUDING NEGLIGENCE), OR ANY OTHER LEGAL THEORY, WHETHER OR
NOT WE HAVE BEEN INFORMED OF THE POSSIBILITY OF SUCH DAMAGE, AND EVEN IF A
REMEDY SET FORTH HEREIN IS FOUND TO HAVE FAILED OF ITS ESSENTIAL PURPOSE.
8.3. Aggregate Liability: IN NO EVENT SHALL ISAI'S AGGREGATE
LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE EXCEED THE GREATER OF ONE
HUNDRED U.S. DOLLARS ($100.00) OR THE AMOUNT YOU PAID ISAI, IF ANY, FOR THE
SERVICE IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
9. Indemnification
You agree to defend, indemnify, and hold harmless ISAI, its
affiliates, licensors, and their respective officers, directors, employees, and
agents from and against any claims, liabilities, damages, judgments, awards,
losses, costs, expenses, or fees (including reasonable attorneys' fees) arising
out of or relating to your violation of these Terms or your use of the Service,
including, but not limited to, your User Data, any use of the Service's
content, services, and products other than as expressly authorized in these
Terms, or your use of any information obtained from the Service.
10. Termination
10.1. By ISAI: ISAI may terminate or suspend your access to the Service immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms.
10.2. By User: You may terminate your account at any time by following the instructions within the Service or by contacting us directly.
10.3. Effect of Termination: Upon
termination, your right to use the Service will immediately cease. All
provisions of these Terms which by their nature should survive termination
shall survive termination, including, without limitation, ownership provisions,
warranty disclaimers, indemnity, and limitations of liability.
11. Governing Law and Dispute Resolution
11.1. Governing Law: These Terms shall be
governed and construed in accordance with the laws of the State of
California, United States, without regard to its conflict of law
provisions.
11.2. Dispute Resolution: Any dispute,
controversy, or claim arising out of or relating to these Terms or the breach,
termination, or validity thereof shall be resolved through binding arbitration
administered by the American Arbitration Association (AAA) in
accordance with its Commercial Arbitration Rules, and judgment on
the award rendered by the arbitrator(s) may be entered in any court having
jurisdiction thereof. The arbitration shall take place in San
Francisco, California, and shall be conducted in the English language.
12. Changes to Terms
ISAI reserves the right, at its sole discretion, to modify
or replace these Terms at any time. If a revision is material, we will provide
at least [Insert Number, e.g., 30] days' notice prior to any new terms taking
effect. What constitutes a material change will be determined at our sole
discretion. By continuing to access or use our Service after those revisions
become effective, you agree to be bound by the revised terms.
